Counter-Notification
If you believe your content has been wrongfully removed (or access has been disabled) and is not infringing, or you have authorization from the copyright owner, the owner’s agent, or under law, you may submit a counter-notice with the following details to our Designated Copyright Agent:
- 1. Your electronic or physical signature;
- 2. Identification of the content that was removed or for which access was disabled, along with the location it was found prior to removal;
- 3. A declaration of your good faith belief that the removal or disabling of the content was due to a mistake or misidentification;
- 4. Your name, physical address, telephone number, email address, a statement consenting to the jurisdiction of the federal court in Seychelles, and a statement confirming that you will accept service of process from the individual who notified you of the alleged infringement.
Upon receiving a counter-notice, our Designated Copyright Agent may send a copy to the original complainant, notifying them that we may restore the removed content or cease disabling it after 10 business days. If the copyright owner does not initiate a court action against the content provider or user, the content may be reinstated or access restored within 10 to 14 business days or at our discretion.
Policy on Repeat Infringers
In alignment with the DMCA and other relevant laws, we maintain a policy for terminating users who are identified as repeat infringers, at our discretion and under appropriate circumstances. Additionally, we may restrict access to the Site and terminate the accounts of any users who infringe on the intellectual property rights of others, regardless of whether there has been repeated infringement.
